Terms of sale

Last updated: 30 October 2026

Article 1 – Seller identification

The website neliaboutique.com (hereinafter “the Site”) is operated by Thibault Fenelon, sole trader (entrepreneur individuel, EI), trading under the name Nelia Boutique, registered with the Paris Trade and Companies Register (RCS) under number 131 796 120, whose business is located at 47 rue Vivienne, 75002 Paris, France (hereinafter “the Seller”). VAT not applicable, article 293 B of the French General Tax Code.

Article 2 – Purpose and scope

These general terms and conditions of sale (T&Cs) govern the sale of clothing, shoes and fashion accessories concluded on the Site between the Seller and any natural person acting as a consumer (hereinafter “the Customer”). They apply to orders delivered to France and to the countries offered at checkout. Any order implies prior acceptance of the T&Cs in force on the date of the order, which the Customer acknowledges having read before confirming their purchase.

Article 3 – Products

The essential characteristics of the products (composition, colours, available sizes) are presented on each product page. Photographs are as accurate as possible; however, slight differences in shade may exist depending on the screen used. Offers are valid while stocks last at our suppliers. If an ordered product turns out to be unavailable after the order, the Customer is informed by email and fully refunded as soon as possible, and no later than 14 days.

Article 4 – Prices

Prices are shown in euros. VAT not applicable, article 293 B of the French General Tax Code. Delivery costs are shown before the order is confirmed and are added to the price of the products, unless otherwise stated. Products are invoiced at the price in force when the order is confirmed.

Article 5 – Orders

The Customer selects their products, checks the contents of their basket and the total price, enters their details and then confirms their order with an obligation to pay. A confirmation email summarising the order is then sent to the Customer. The Seller reserves the right to cancel any order in the event of a previous payment dispute, suspected fraud or product unavailability; the Customer is then fully refunded.

Article 6 – Payment

Payment is due at the time of ordering. It is made using the methods offered at checkout (bank card, PayPal, digital wallets), through secure payment providers. Bank details are processed directly by these providers and are never stored by the Seller.

Article 7 – Shipping and delivery

Products are shipped from the warehouses of our logistics partners, located in particular in China, to the address given by the Customer when ordering. Indicative delivery times and costs are shown on our Delivery & shipping page and are repeated before payment.

The tracking number is sent to the Customer by email as soon as the parcel reaches its destination country.

In accordance with article L216-1 of the French Consumer Code, the Seller delivers the products no later than 30 days after the conclusion of the contract, unless a different period is indicated to the Customer. In the event of a delay, the Customer may, under the conditions of articles L216-6 et seq. of the French Consumer Code, terminate the contract and obtain a refund of the sums paid. If the loss of the parcel is confirmed by the carrier, the Seller re-ships the order or refunds it in full, at the Customer's choice.

The risk of loss of or damage to the products passes to the Customer when they take physical possession of the products. If a parcel is damaged, the Customer is invited to contact us as soon as possible, with photos.

Article 8 – Right of withdrawal and exchange

In accordance with articles L221-18 et seq. of the French Consumer Code, the Customer has a legal period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give any reason. The Seller extends this period to 15 days from receipt. These provisions apply to all products, including sale items.

Size exchange: within the same period, the Customer may request to exchange a product for another size, subject to availability, by writing to neliaboutique.contact@gmail.com with their order number and the size they would like. The new product is shipped as soon as the returned item is received. If the requested size is unavailable, the Customer may choose another product or a refund.

To exercise their right of withdrawal, the Customer sends the Seller, before this period expires, an unambiguous statement (for example by email to neliaboutique.contact@gmail.com, stating their order number), or uses the withdrawal form at the end of these T&Cs. The Seller then provides the return address. The Customer sends the products back no later than 14 days after communicating their decision.

Products must be returned complete, in their original condition, unworn, unwashed and with their tags. The Customer may be held liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Return costs are borne by the Customer, unless the product is faulty or non-conforming.

The Seller refunds all sums paid, including the original delivery costs (based on the standard delivery method), no later than 14 days from the date on which it is informed of the decision to withdraw. It may withhold the refund until it has received the products back or until the Customer has supplied proof of having sent them. The refund is made using the same payment method as the one used for the order.

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for goods that have been unsealed by the Customer after delivery and which cannot be returned for reasons of hygiene or health protection (for example certain underwear or swimwear whose hygiene seal has been removed).

Orders placed before 30 October 2026 remain subject to the 30-day period set out in the T&Cs in force at that time.

Article 9 – Legal guarantees

Independently of the right of withdrawal, all products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

Under the legal guarantee of conformity, the Customer has two years from delivery of the goods to take action; they may obtain repair or replacement of the goods or, failing that, a price reduction or termination of the contract, and do not have to prove the defect during this period. Under the guarantee against hidden defects, the Customer may choose between cancelling the sale and a price reduction, within two years of discovering the defect.

For any claim, the Customer contacts the Seller at neliaboutique.contact@gmail.com, stating their order number and, if possible, including photos of the product.

Article 10 – Liability and force majeure

The Seller cannot be held liable for failure to perform the contract in the event of force majeure within the meaning of article 1218 of the French Civil Code, in particular in the event of serious disruption to transport services. The Customer is then informed as soon as possible.

Article 11 – Personal data

The Customer's personal data is necessary to process their order. It is processed in accordance with the GDPR, under the conditions described in our Privacy Policy.

Article 12 – Customer service, complaints and mediation

For any question or complaint, the Customer can contact customer service at neliaboutique.contact@gmail.com. We reply as quickly as possible.

In accordance with articles L612-1 et seq. of the French Consumer Code, in the event of a dispute that has not been resolved after a written complaint to the Seller, the Customer has the right to use a consumer mediator free of charge. The Seller is in the process of joining a mediation scheme; the name and contact details of the competent mediator will be given here as soon as this membership is finalised.

Article 13 – Applicable law

These T&Cs are governed by French law. This clause does not deprive a consumer Customer residing in another European Union country of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute, and failing an amicable solution, the competent courts are those designated by the applicable legal rules.
