VAT not applicable, article 293 B of the French General Tax Code (CGI).

Article 2 – Purpose and scope

These terms and conditions of sale (the “Terms”) govern sales of clothing, shoes and fashion accessories made on the Website between the Seller and any natural person acting as a consumer (the “Customer”). They apply to orders delivered to France and to the countries offered at checkout. Every order implies prior acceptance of the Terms in force on the date of the order, which the Customer acknowledges having read before confirming the purchase.

Article 3 – Products

The essential characteristics of the products (composition, colours, available sizes) are shown on each product page. Photographs are as accurate as possible; however, slight colour differences may occur depending on the screen used. Offers are valid while stocks last at our suppliers. If an ordered product turns out to be unavailable after the order, the Customer is informed by email and refunded in full as soon as possible, and no later than within 14 days.

Article 4 – Prices

Prices are shown in euros. VAT not applicable, article 293 B CGI. Delivery charges are shown before the order is confirmed and are added to the price of the products unless stated otherwise. Products are invoiced at the price in force when the order is confirmed.

Article 5 – Orders

The Customer selects products, checks the contents of the cart and the total price, enters their details and then confirms the order with an obligation to pay. A confirmation email summarising the order is then sent to the Customer. The Seller reserves the right to cancel any order in the event of a previous payment dispute, suspected fraud or product unavailability; the Customer is then refunded in full.

Article 6 – Payment

Payment is due at the time of order. It is made using the methods offered at checkout (bank card, PayPal, digital wallets) via secure payment providers. Bank details are processed directly by these providers and are never stored by the Seller.

Article 7 – Shipping and delivery

Products are shipped from the warehouses of our logistics partners, located in particular in China, to the address given by the Customer when ordering. Estimated delivery times and charges are shown on our Shipping & delivery page and are displayed again before payment.

The tracking number is sent to the Customer by email as soon as the parcel arrives in the destination country.

In accordance with article L216-1 of the French Consumer Code, the Seller delivers the products no later than 30 days after the contract is concluded, unless a different time is indicated to the Customer. In the event of delay, the Customer may, under the conditions of articles L216-6 et seq. of the French Consumer Code, terminate the contract and obtain a refund of the amounts paid. If the loss of a parcel is confirmed by the carrier, the Seller resends the order or refunds it in full, at the Customer's choice.

The risk of loss or damage to the products passes to the Customer when they take physical possession of the products. If a parcel arrives damaged, the Customer is asked to contact us as soon as possible, with photos.

Article 8 – Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, the Customer has a statutory period of 14 days from receipt of the products to exercise the right of withdrawal, without giving any reason. The Seller extends this period to 30 days from receipt.

To exercise this right, the Customer sends the Seller, before the period expires, an unambiguous statement (for example by email to neliaboutique.contact@gmail.com, stating the order number), or uses the withdrawal form at the end of these Terms. The Seller will then provide the return address. The Customer must send the products back no later than 14 days after communicating the decision.

Products must be returned complete, in their original condition, unworn, unwashed and with their tags. The Customer may be liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics and functioning. Return costs are borne by the Customer, except for defective or non-conforming products.

The Seller refunds all amounts paid, including the original delivery charges (based on standard delivery), no later than 14 days from the date on which it is informed of the withdrawal. It may withhold the refund until it has received the products back or until the Customer has supplied proof of having sent them. The refund is made using the same payment method as used for the order.

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery (for example certain underwear or swimwear whose hygiene seal has been removed).

Article 9 – Legal guarantees

Regardless of the right of withdrawal, all products benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).

Under the legal guarantee of conformity, the Customer has two years from delivery of the goods to act; they may obtain repair or replacement of the goods or, failing that, a price reduction or termination of the contract, and do not need to prove the defect during this period. Under the guarantee against hidden defects, the Customer may choose between cancelling the sale and a price reduction, within two years of discovering the defect.

For any claim, the Customer contacts the Seller at neliaboutique.contact@gmail.com, stating the order number and, where possible, providing photos of the product.

Article 10 – Liability and force majeure

The Seller cannot be held liable for non-performance of the contract in the event of force majeure within the meaning of article 1218 of the French Civil Code, in particular serious disruption of transport services. The Customer will be informed as soon as possible.

Article 11 – Personal data

The Customer's personal data is necessary to process the order. It is processed in accordance with the GDPR, under the conditions described in our Privacy Policy.

Article 12 – Customer service, complaints and mediation

For any question or complaint, the Customer can contact customer service at neliaboutique.contact@gmail.com. We reply as quickly as possible.

In accordance with articles L612-1 et seq. of the French Consumer Code, if a dispute remains unresolved after a written complaint to the Seller, the Customer has the right to use a consumer mediator free of charge. The Seller is in the process of joining a mediation scheme; the name and contact details of the competent mediator will be given here as soon as this membership is finalised.

Article 13 – Applicable law

These Terms are governed by French law. This clause does not deprive a consumer residing in another European Union country of the protection afforded by the mandatory provisions of the law of their country of residence. In the event of a dispute, and failing an amicable solution, the competent courts are those designated by the applicable legal rules.
